PartyQueue Terms of Service

These Terms of Service ("Terms") govern your access to and use of PartyQueue (the "Service"), operated by TJ Audio Productions (ABN 17 373 031 383), trading as PartyQueue ("we", "us", "our"). By creating an account, starting a free trial, or subscribing to PartyQueue, you agree to these Terms. If you do not agree, do not use the Service.
1. Who this applies to
PartyQueue is offered to DJs, event companies, venues and their staff ("Operators" or "you"). Guests who submit song requests through an Operator's event page do so under our Privacy Policy and the acceptable use rules in Section 6 — guests do not need an account and are not "subscribers" under these Terms.
2. The Service
PartyQueue lets an Operator create live events where guests scan a QR code or link and submit song requests, which the Operator sees on a ranked, real-time dashboard. Features (branding, seats, multi-operator controls, etc.) vary by subscription plan as described on the pricing page.
3. Accounts
- You must provide accurate, current information when creating an account and keep your login credentials secure.
- You're responsible for all activity under your account, including actions taken by staff or DJs you add under an Enterprise/Multi-op plan.
- You must be at least 18 years old to hold an Operator account.
4. Subscriptions, billing and price changes
- PartyQueue is offered on a subscription basis only — there are no single-event licenses.
- Subscriptions renew automatically at the end of each billing cycle (monthly or annual, as selected at signup) until cancelled.
- You authorise us (via our payment processor) to charge your nominated payment method each renewal period.
- We will give you at least 14 days' notice by email before any price increase takes effect on your next renewal. Continuing your subscription after that date means you accept the new price; if you don't agree, you may cancel before the renewal date at no further charge.
- Free trials (if offered) convert to a paid subscription automatically at the end of the trial unless you cancel before it ends. We will clearly disclose the trial length and the price that applies after conversion at signup.
- All prices are in Australian dollars and, unless stated otherwise, inclusive of GST where applicable.
5. Cancellation
- You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you keep access until then, and we don't charge you again after that.
- We don't charge cancellation fees.

6. Acceptable use
You must not use PartyQueue to:
- Upload, request, or associate content that is unlawful, defamatory, harassing, hateful, sexually explicit, or infringes someone else's rights;
- Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service or other users' data;
- Use the guest request system to collect personal information from guests beyond what's needed to run the event, or to spam guests;
- Resell, sublicense, or white-label the Service beyond what your plan expressly permits.
We may suspend or terminate accounts that breach this section, with notice where reasonably practicable. See also our Acceptable Use Policy.
7. Guest-submitted content
Song requests, guest display names, and related content submitted through an event page are visible to the Operator running that event and, depending on Operator settings, to other guests. We are not responsible for verifying the accuracy of guest-submitted names or requests. Operators are responsible for moderating their own events (e.g. via the do-not-play list and pause controls).
8. Intellectual property and software licence
PartyQueue, its logo, software and underlying technology are owned by TJ Audio Productions or its licensors. This section is your licence to use that software.
8.1 Licence grant. Subject to your active subscription and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own event and DJ business purposes, in accordance with the features included in your plan tier.
8.2 Restrictions. You must not, and must not permit any third party to:
- Copy, modify, reverse-engineer, decompile, or create derivative works of the Service, except to the extent expressly permitted by law;
- Sell, rent, lease, sublicense, distribute, or white-label the Service beyond what your subscription plan expressly permits (e.g. Enterprise/white-label features);
- Remove or alter any proprietary notices or branding embedded in the Service (other than your own branding on Pro/Enterprise plans, applied through supported customisation features);
- Use the Service to build a competing product;
- Circumvent any usage limits, seat limits, or access controls tied to your subscription plan.
8.3 Your content. You retain ownership of your own branding assets (logos, colours, event copy) that you upload under Pro/Enterprise plans. You grant us a licence to host, display and process that content solely to provide the Service to you and, where applicable, to your event guests.
8.4 Updates. We may update, patch, or modify the Service from time to time to improve functionality, security or performance. We'll aim to avoid material negative changes to core features you're actively paying for without reasonable notice.
8.5 Licence ends with your subscription. This licence ends automatically if your subscription lapses or is cancelled, or if you breach these Terms. On termination, your right to access and use the Service ends, though provisions relating to ownership, liability and confidentiality survive.
9. Third-party services
PartyQueue integrates with third-party services (for example, music catalogue matching and Stripe for payment processing). Your use of those integrations may also be subject to that provider's terms. We aren't responsible for the availability or accuracy of third-party services.
10. Consumer guarantees (Australian Consumer Law)
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded. Where our liability for breach of a non-excludable guarantee can be limited, our liability is limited, at our option, to re-supplying the Service or the cost of having it re-supplied.
11. Disclaimer and limitation of liability
To the maximum extent permitted by law and subject to Section 10:
- PartyQueue is provided "as is." We don't guarantee the Service will be uninterrupted, error-free, or available at all times (e.g. during scheduled maintenance or events outside our control).
- We are not liable for indirect, incidental, or consequential loss (including lost bookings or lost profits) arising from your use of the Service.
- Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months before the claim arose.
12. Termination
We may suspend or terminate your account for breach of these Terms, non-payment, or unlawful use, with notice where reasonably practicable. You may stop using the Service and cancel your subscription at any time.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in-app notice at least 14 days before they take effect. Continued use after that date means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
